By accessing or using WorkGena's AI voice receptionist service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

2. Description of Service

WorkGena provides an AI-powered voice receptionist service that handles incoming phone calls, books appointments, answers customer queries, and provides related analytics and dashboard features for businesses.

3. Account Registration

To use our Service, you must provide accurate and complete business information during setup. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Billing

  • Subscription plans are billed monthly based on the plan you select.
  • Free live demo calls are available anytime (no signup needed) — see our demo page. Paid plans do not include a free trial, but come with a 7-day money-back guarantee on the first paid charge.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are governed by our Refund & Cancellation Policy, which includes a 7-day money-back guarantee on the first paid charge.
  • Payment processing for Indian customers is handled via Razorpay, and for international customers via Dodo Payments.
  • We reserve the right to modify pricing with 30 days advance notice.

5. Acceptable Use

You agree not to use the Service to:

  • Engage in any illegal, fraudulent, or harmful activity
  • Transmit spam, unsolicited communications, or harassing content
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to reverse-engineer, decompile, or access the source code of the Service
  • Use the Service for any purpose that violates applicable laws or regulations

6. Service Availability

We strive to maintain high availability of our Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our control.

7. AI Limitations

Our AI receptionist is designed to handle common business calls accurately. However, AI technology has inherent limitations. We do not guarantee 100% accuracy in call handling, appointment booking, or query responses. Critical or emergency situations should always have human backup procedures in place.

8. Intellectual Property

All content, technology, software, and intellectual property related to WorkGena remain our exclusive property. You are granted a limited, non-exclusive, non-transferable license to use the Service for the duration of your subscription.

9. Data Ownership

You retain ownership of all business data, call recordings, and customer information processed through our Service. We do not claim ownership of your data. See our Privacy Policy for details on how we handle your data.

10. Limitation of Liability

To the maximum extent permitted by law, WorkGena shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, lost business opportunities, or data loss arising from your use of the Service.

11. Termination

Either party may terminate the subscription at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your access to the Service will cease, and we will retain your data for 30 days before permanent deletion unless otherwise requested.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. Failing amicable resolution, all disputes shall be subject to the exclusive jurisdiction of the competent courts of Purba Medinipur, West Bengal, India.
